1. Agreement to Terms
By accessing and using ADA Lab JHB services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services
ADA Lab JHB provides aquascaping services including:
- Aquascaping design and consultation
- Workshop bookings and training
- Sale of aquarium plants, equipment, and accessories
- Maintenance and support services
3. Workshop Bookings
Booking Policy: Workshop bookings require advance payment and are subject to availability. Bookings are confirmed upon receipt of payment.
Cancellation Policy: Cancellations must be made at least 48 hours in advance for a full refund. Cancellations within 48 hours are subject to a 50% cancellation fee.
Rescheduling: Workshops may be rescheduled once without penalty, subject to availability.
No-Show Policy: No refunds will be provided for no-shows without prior notice.
4. Online Ordering and E-Commerce
Order Acceptance: All orders are subject to acceptance by ADA Lab JHB. We reserve the right to refuse or cancel any order at our discretion.
Pricing: All prices displayed include VAT and are in South African Rand (ZAR). Prices are subject to change without notice.
Payment: Payment is required at the time of ordering. We accept major credit cards and electronic payments through our secure payment processors.
Order Confirmation: You will receive email confirmation of your order. This confirmation does not constitute acceptance of your order until goods are dispatched.
5. Shipping and Delivery
Shipping Areas: We ship within South Africa. Delivery times are estimates and may vary based on location and courier availability.
Shipping Costs: Shipping costs are calculated based on weight, size, and destination. Final shipping costs will be displayed during checkout.
Risk of Loss: Risk of loss passes to you upon delivery to the address you specified. We are not responsible for lost or stolen packages after delivery.
Pickup Option: Customers may choose to collect orders from our facility during business hours by prior arrangement.
6. Plant and Product Sales
Plant Health Guarantee: All plants are sold in healthy condition and shipped with care. However, we cannot guarantee plant survival after delivery as this depends on proper care, aquarium conditions, and handling.
Live Goods Policy: Plants and other live goods are sold "as is" and are non-returnable due to their perishable nature. Please inspect immediately upon receipt.
Equipment Returns: Non-live equipment may be returned within 7 days of delivery in original, unused condition with all packaging and documentation.
Damaged Goods: Report any damaged items within 24 hours of delivery with photographic evidence for replacement consideration.
Availability: Product availability is subject to change. We reserve the right to substitute similar items when necessary, with your consent.
7. Returns and Refunds
Consumer Protection: This policy complies with the Consumer Protection Act of South Africa. You have the right to return goods within the cooling-off period where applicable.
Refund Processing: Approved refunds will be processed within 7-14 business days to the original payment method.
Return Shipping: Customers are responsible for return shipping costs unless the item was damaged or defective upon arrival.
Restocking Fee: A 15% restocking fee may apply to returns of special order items or custom equipment.
8. Payment Terms
Payment Security: All payments are processed securely through our certified payment partners using industry-standard encryption.
Payment Methods: We accept major credit cards, debit cards, and electronic funds transfer (EFT).
Failed Payments: Orders with failed payments will be cancelled automatically. You will be notified of payment failures.
Currency: All transactions are processed in South African Rand (ZAR). Foreign currency conversions are handled by your payment provider.
9. Data Protection and Privacy
POPI Act Compliance: We collect and process personal information in accordance with the Protection of Personal Information Act (POPI Act) of South Africa.
Data Usage: Personal information is used solely for order processing, delivery, customer service, and marketing communications (with consent).

10. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of ADA Lab JHB or its content suppliers and is protected by South African and international copyright laws. Unauthorized use is prohibited.
11. Limitation of Liability
Liability Limits: ADA Lab JHB's liability for any claim related to these services shall not exceed the amount paid for the specific product or service in question.
Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption.
Consumer Rights: Nothing in this clause limits your rights under the Consumer Protection Act where such limitation would be unlawful.
12. Dispute Resolution
Preferred Resolution: We encourage direct communication to resolve any issues. Please contact us first before pursuing formal dispute resolution.
Governing Law: These terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
Consumer Protection: Your rights under the Consumer Protection Act and other applicable consumer protection legislation remain unaffected.
13. Force Majeure
ADA Lab JHB shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disasters, or government actions.
14. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of any modifications.
